These Terms & Conditions of Purchase (“Terms”) govern participation in auctions operated by Agro-Stock Depo Kft.

By registering and placing bids on our website, you (“the Buyer”) agree to be bound by these Terms, which define your rights and obligations regarding purchases and participation in auctions organized or mediated by Agro-Stock Depo Kft.

Registration as a bidder constitutes acknowledgment that you have read, understood, and accepted these Terms in full.

Agro-Stock Depo Kft acts as an intermediary and escrow service provider between sellers and buyers.

Agro-Stock Depo Kft does not own the items listed on the website and acts solely on behalf of private sellers, companies, or institutions (“the Sellers”).

Agro-Stock Depo Kft’s role is to facilitate the sales process, handle buyer payments, and ensure a transparent and secure transfer of ownership once payment is confirmed and all conditions are met.

Agro-Stock Depo Kft does not act as exporter, importer, or customs declarant unless otherwise stated in writing.

All items listed on agro-stock-depo.eu are sold either through online auction or via a “BUY NOW (ASK FOR PRICE)” option, when available.

Bidding is open around the clock and closes at a scheduled time for each listing. If a bid is placed within three (3) minutes prior to closing, the auction will be automatically extended by three (3) additional minutes to ensure fair competition.

All items are verified and inspected by our technical team before listing to ensure authenticity and proper condition. Each item sold through Agro-Stock Depo Kft is subject to inspection and quality control prior to sale.

Agro-Stock Depo Kft accepts no liability for technical failures, connection issues, software errors, bids not being registered, or inability to access the website or contact the bidder or seller.

Once an auction closes or a “BUY NOW (ASK FOR PRICE)” purchase is completed, the buyer will receive a confirmation and invoice by email within 24 hours.

The issuance of the invoice is considered official confirmation of the transaction and establishes formal contact between Agro-Stock Depo Kft and the Buyer.

To participate in any auction or make a direct purchase on agro-stock-depo.eu, all buyers must first have a verified buyer account created and approved by Agro-Stock Depo Kft.

Buyer registration is available to Hungarian and foreign companies, as well as private individuals aged 18 or above.

At Agro-Stock Depo Kft, buyer registration is personally handled by our team to ensure authenticity and prevent fraud. To open a buyer account, please contact us directly via email, and our representatives will create and activate the account for you.

Registering under a false name or on behalf of another person or entity without authorization may result in permanent suspension and legal consequences under applicable Hungarian law.

By requesting registration, you consent to the processing of your personal data in accordance with EU Regulation (GDPR) 2016/679 and Hungarian data protection laws for verification and communication purposes.

If Agro-Stock Depo Kft suspects misuse of an account, non-compliance with these Terms, or any irregular activity, we reserve the right to suspend, block, or permanently ban the buyer from further participation.

Agro-Stock Depo Kft also reserves the right to reject any bidder or cancel a sale without prior notice or justification.

The winning bidder (Buyer) must complete full payment within twenty-four (24) hours from the time the auction result is confirmed and the invoice is issued.

For purchases made through the “BUY NOW (ASK FOR PRICE)” option, the same 24-hour payment deadline applies from the moment the buyer receives the invoice by email.

All payments must be made directly to Agro-Stock Depo Kft’s official bank account as stated on the invoice. Payments made to sellers or third parties are not considered valid unless confirmed and approved by Agro-Stock Depo Kft.

Failure to complete payment within the required timeframe entitles Agro-Stock Depo Kft to cancel the transaction, re-list or re-auction the item, and apply applicable provisions under Hungarian law (Act V of 2013), including claims for damages, loss of profit, and administrative expenses.

Agro-Stock Depo Kft reserves the right to retain any deposit or partial payment as compensation for losses resulting from non-payment or breach of these Terms.

Agro-Stock Depo Kft operates as an escrow intermediary between the seller and the buyer. Ownership is transferred only after Agro-Stock Depo Kft confirms receipt of full payment and the transaction has been validated.

Collection or delivery of purchased items must take place within 29 calendar days from payment confirmation, unless otherwise agreed in writing by all parties.

Agro-Stock Depo Kft may assist in arranging transport or export services upon request; however, these services are separate from the auction process and may involve additional costs.

Agro-Stock Depo Kft does not assume liability for transport delays, damages during transit, or customs clearance procedures.

All items are sold on behalf of the Seller, who remains fully responsible for the accuracy of the description, condition, documentation, and ownership of each item.

Agro-Stock Depo Kft acts solely as an intermediary and cannot guarantee or warrant the physical or mechanical condition of any item beyond the information provided by the Seller.

However, all items are checked and inspected by our technical team prior to listing to ensure that the description and condition correspond to the actual state of the item at the time of publication. This verification process is intended to ensure transparency and reliability for all buyers.

Buyers are strongly encouraged to request additional photos, videos, or technical information before placing a bid or making a purchase.

Once a bid is placed, it is legally binding under applicable Hungarian law and cannot be withdrawn without the written approval of Agro-Stock Depo Kft.

By placing a bid, the Buyer agrees to purchase the item at the final winning bid price and to fully comply with all payment and collection obligations.

If the Buyer wins an auction or purchases an item through the “BUY NOW (ASK FOR PRICE)” option, the Buyer is legally obligated under applicable Hungarian and EU commercial law to complete payment within forty-eight (48) hours after receiving the invoice issued by Agro-Stock Depo Kft.

Failure to make payment or arrange collection within the required timeframe entitles Agro-Stock Depo Kft to take legal action under Hungarian jurisdiction, claim compensation for financial losses, storage fees, or administrative costs, and suspend or block the Buyer’s account from future participation.

All purchases made through agro-stock-depo.eu are considered Business-to-Business (B2B) transactions unless explicitly stated otherwise. Private individuals may participate only when specifically permitted in the listing description or approved in writing by Agro-Stock Depo Kft.

Following the conclusion of an auction or a “BUY NOW (ASK FOR PRICE)” purchase, the Buyer has 15 calendar days from the date of payment confirmation to collect the purchased item, unless otherwise stated in the specific listing.

Certain listings may include different collection terms, which will override these general conditions.

Before collection, the invoice must be fully paid and confirmed by Agro-Stock Depo Kft. Once payment is verified, the Buyer will receive a Collection Authorization Document by email, including the seller’s contact details to arrange a pickup appointment.

Unless otherwise agreed, the Buyer is responsible for collecting the item, as well as providing all necessary transport, loading, unloading, and dismantling arrangements if required.

If the Buyer fails to collect the item within the 15-day period, Agro-Stock Depo Kft reserves the right to transfer the item to a storage facility, with all handling and storage costs borne by the Buyer. A storage fee of EUR 50 (excluding VAT) per week per item will apply after the initial 15 days.

If collection is not completed within 30 days from payment confirmation, Agro-Stock Depo Kft may re-auction or dispose of the item. Any resale proceeds will be used to cover outstanding costs, and no refund or compensation will be due if the resale value is lower than the original purchase price.

If the Seller is unable to facilitate collection within the agreed timeframe, the Buyer may request rescheduling or termination of the agreement. In such cases, Agro-Stock Depo Kft will refund the purchase amount, provided the delay was not caused by the Buyer or force majeure circumstances.

Neither Agro-Stock Depo Kft nor the Seller is responsible for any damage, loss, or deterioration caused by delayed collection or improper transport arrangements made by the Buyer.

By placing a bid or completing a purchase, the Buyer acknowledges that logistical, transport, or storage costs may in some cases exceed the purchase price and fully accepts these conditions.

Agro-Stock Depo Kft operates in accordance with Hungarian and EU VAT legislation regarding the sale and export of machinery and equipment within and outside the European Union.

10.1 EU Sales

If you are a foreign buyer located within the European Union, you must provide a valid company VAT number prior to or immediately after purchase. Only companies registered for intra-EU trade (VIES-valid VAT numbers) are eligible to purchase items without Hungarian VAT under the intra-Community supply exemption.

All invoices are issued with Hungarian VAT (27%) applied, unless a valid VAT number is provided and verified before invoicing. If a valid VAT number is submitted after payment and export is confirmed, Agro-Stock Depo Kft will refund the VAT amount to the same IBAN used for the original payment.

To request a VAT refund, the Buyer must submit all required export or transport documentation to info@agro-stock-depo.eu no later than 30 days after payment confirmation.

VAT refunds are processed monthly, following verification of all required documents. Failure to submit documentation within the deadline may result in the loss of eligibility for a VAT refund.

Required documents for intra-EU sales:

• Signed Buyer Statement issued by Agro-Stock Depo Kft confirming delivery outside Hungary
• CMR transport document, signed and stamped by both sender and recipient (if transport is carried out by a freight company)
• Copy of the Buyer’s VAT certificate (showing the EU VAT number)
• Buyer’s IBAN and SWIFT/BIC details used for the original payment

VAT refunds are always transferred only to the same bank account used for the original purchase. Requests to transfer refunds to a different account may be refused or subject to additional verification, including confirmation that the account belongs to the same legal entity or individual.

10.2 Export Outside the European Union (Non-EU Buyers)

If you are a buyer located outside the EU, you are required to export the purchased item from the European Union. Upon request, you must provide official export documentation confirming that the item has physically left the EU customs territory.

To qualify for VAT-free export, the Buyer must submit the following documents to Agro-Stock Depo Kft within 30 days after payment confirmation:

Required documents for export outside the EU:

• Official Customs Export Declaration (EX-1) or equivalent document stamped by customs authorities
• Copy of Bill of Lading, Air Waybill, or CMR document confirming delivery to the destination country
• Buyer’s IBAN and SWIFT/BIC details used for the original payment

Failure to provide complete export documentation within the required timeframe may result in the transaction being treated as a domestic sale, and VAT will not be refunded.

All approved VAT refunds will be transferred exclusively to the same IBAN used for the original purchase payment.

10.3 Additional Notes

• Private individuals, regardless of residence, are not eligible for VAT-free purchases or refunds.
• Agro-Stock Depo Kft reserves the right to refuse VAT exemption or refund in cases of incomplete, incorrect, or falsified export documentation.
• Agro-Stock Depo Kft does not act as exporter or customs declarant on behalf of the Buyer unless otherwise agreed in writing.
• Buyers are responsible for full compliance with all applicable Hungarian and EU customs regulations regarding export procedures.

Agro-Stock Depo Kft shall not be liable for any indirect, consequential, or incidental damages, loss of profit, loss of time, or loss of data, nor for any technical malfunction, downtime, or website error.

In any transaction, Agro-Stock Depo Kft’s total liability shall in all cases be limited to the commission or service fee received for the specific auction in question.

These Terms shall be governed by and interpreted in accordance with the laws of Hungary and applicable EU legislation.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Budapest, Hungary.

Agro-Stock Depo Kft reserves the right to amend or update these Terms at any time.

Any changes take effect immediately upon publication on agro-stock-depo.eu.

Buyers are responsible for reviewing the Terms before participating in each auction.
